Provider Membership Agreement

This Agreement applies to any hospital, clinic, dental practice, doctor or other practitioner (“Provider”, “you”) that purchases or holds a listing on ExBeauty (“we”, “us”, “our”). By completing checkout on List Your Business, you agree to be bound by it, alongside our Terms of Service.
1. What This Agreement Is — and Isn’t
ExBeauty operates a directory and lead-generation marketplace: we give patients (“Clients”) information about Providers to help them choose one that suits their needs, and where a Client chooses to contact you, we pass on their enquiry details (“a Lead”). If a Client goes on to engage you for treatment, the contract for that treatment is directly between you and the Client — no contract for the provision of medical services exists, or is intended to exist, between you and ExBeauty. Our agreement with you is solely for the provision of your listing and the Leads it generates.
2. Your Warranties
By listing on ExBeauty, you confirm that:
- You hold a valid, current licence or registration to provide the medical services you list, issued by the relevant regulatory authority in your country, and you will notify us immediately if that licence lapses or is suspended;
- All information you provide us — including your qualifications, accreditation, pricing, photographs and contact details — is accurate, current, and not misleading, and you will notify us promptly of any change;
- You will only accept Leads for treatments you are genuinely qualified and equipped to provide;
- You maintain appropriate medical negligence / malpractice, public liability and professional indemnity insurance (or the closest local equivalent) covering the services you list; and
- The content you submit does not infringe any third party’s intellectual property, and does not contain anything defamatory, obscene or unlawful.
3. Responding to Leads
You agree to make a genuine effort to contact each Lead we send you — by phone and/or email — within two business days of receiving it.
4. Data Protection
Any Client personal data we pass to you as part of a Lead must be: used only to respond to and fulfil that enquiry; kept secure; not sold, shared with a third party, or added to a marketing list without the Client’s explicit separate consent; and handled in line with the UK GDPR and your own country’s equivalent data protection law. If a Client asks you directly to delete their data, you must do so unless you’re legally required to retain it (e.g. medical or financial records).
5. Badges & Verification
Badges such as “Verified Provider” or accreditation badges reflect checks we’ve carried out or evidence you’ve supplied to us — they are not an independent guarantee by ExBeauty of your clinical quality or outcomes. Misrepresenting your accreditation, qualifications or insurance is a material breach of this Agreement and grounds for immediate removal without refund.
6. Reviews
You must not write or arrange for anyone else to write a review of your own listing or of a competitor, and must not offer a discount, refund or payment in exchange for a positive review. See our Review Policy. You consent to genuine patient reviews about you — positive or negative — being published, including after your listing ends.
7. Fees, Placement & Exclusivity
Fees and billing periods are as shown on List Your Business at the time you subscribe, and are billed automatically until you cancel. A Featured tier (#1, #2 or #3) is exclusive to one Provider per city at a time; if your subscription for that tier lapses or is cancelled, the placement becomes available to another Provider. Refunds are governed by our Refund Policy.
8. Suspension & Termination
We may suspend or remove your listing at any time, without notice, if: you breach this Agreement or our Terms of Service; we can’t verify information you’ve submitted; your professional licence lapses or is suspended; you fail to pay a subscription fee when due; or we reasonably believe your conduct risks patient safety or trust in the platform. You may cancel your own listing at any time by contacting us; cancellation takes effect at the end of your current billing period.
9. Limitation of Liability & Indemnity
To the fullest extent permitted by law, ExBeauty is not liable for any loss arising from a Client’s conduct, your dealings with a Client, or your provision of (or failure to provide) medical services. You agree to indemnify us against any claim, loss or cost arising from your breach of this Agreement, your provision of medical services, or your use of the site.
10. Governing Law
This Agreement is governed by the laws of England and Wales.
